Terms of Use for Butr

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and Toast Studios, Inc. ("Toast," "we," "our," or "us") governing your access to and use of the Butr application ("Butr" or the "App") and all related services.

1. Acceptance of Terms

By accessing or using Butr, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and any other policies referenced herein. If you do not agree to these Terms, do not access or use Butr.

We may amend these Terms at any time. If we do, we will post the revised Terms on this page with a new effective date. Your continued use of Butr after changes are posted constitutes acceptance of the new Terms.

2. Eligibility and Geographic Restrictions

You must be at least 18 years of age to use Butr. By using Butr, you represent and warrant that:

• You are 18 years or older;
• You have the legal capacity to enter into these Terms;
• You are not accessing Butr from a restricted jurisdiction.

Restricted Jurisdictions: Users located in Arizona, Iowa, Louisiana, Michigan, and South Carolina are not permitted to create accounts or participate in any real-money contests.

We reserve the right to restrict access to Butr or suspend accounts based on geolocation, suspicious activity, or for compliance reasons.

3. Description of Services

Butr is a real-money skill-based gaming platform that offers competitive multiplayer games. Users may participate in contests that require entry fees, and winners may receive real money rewards. The outcome of each contest is based on the user's skill and not chance.

Toast does not offer gambling or games of chance. All games hosted on Butr are designed to comply with U.S. laws regarding games of skill.

4. Account Creation and Management

To access certain features, you must register an account and provide truthful, accurate, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

We reserve the right to:

6. Taxes

You are solely responsible for determining and paying any taxes associated with your use of Butr. If required by law, Toast may issue tax forms such as Form 1099 and report user earnings to tax authorities.

7. Fair Play and Prohibited Conduct

• Use of cheats, bots, or unauthorized third-party software;

• Collusion with other users;

Toast reserves the right to investigate suspected violations and take appropriate action, including suspending or banning accounts and withholding funds.

8. Responsible Gaming

11. Disclaimer of Warranties

Your use of Butr is at your sole risk. The platform and services are provided "as is" and "as available," without warranties of any kind. We do not warrant that:

• The service will be error-free or uninterrupted;
• The results will meet your expectations;
• Any issues will be corrected promptly.

12. Limitation of Liability

To the fullest extent permitted by law, Toast Studios, Inc. shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with:

• Your use of or inability to use Butr;
• Any errors or inaccuracies in the service;
• Unauthorized access to your data.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute or claim shall be resolved through final and binding arbitration in Delaware.

You and Toast agree to waive any right to a jury trial or to participate in a class action.

14. Termination

Toast may suspend or terminate your access to Butr at any time for violating these Terms or applicable law. Termination may result in the forfeiture of winnings or account balance in cases involving fraud or abuse.

You may terminate your account by contacting support, subject to account reconciliation.
